The lingering forgery of certificate involving Hon. Ibrahim Baba Hassan a member representing Jos North North at the Plateau State House of Assembly was held yesterday at the Jos federal high court.
Hon. Ibrahim Baba Hassan is standing trial on eight count charge file by the Federal government through the office of the Attorney General of the Federation (AGF) and minister of justice Abubakar Malami (SAN) before the Federal High Court Jos.
Honourable Baba Hassan had pleaded not guilty to his offences after they were read out to him on the 28 February 2018, However, the presiding judge Musa Kurya asked the prosecution counsel to respond to earlier application file by the defence counsel seeking the court to stroke out the case and discharged the defendant due to absence of the prosecution counsel in last sitting.
The prosecution counsel responded that “the section cited by the defence counsel is referred to the nominal complainer not the prosecution counsel and also only applicable for the first sitting”. The nominal complainer is in the court and always being in the court.
Similarly, the prosecution counsel raised a point of order that during the last sitting when the defendant was arraigned neither the him nor his counsel apply for bail.Then he should be remand in prison custody due to over-weight evidence against him and he can runaway because he has two pending cases against him.
He further, argued that the defendant was not on bail and if he runaway there’s nobody to hold responsible. So, he should be remand in prison custody till next sitting. But the defence counsel vehemently rejected the submission.
Meanwhile, the case has been adjourned to 13th April 2018 by justice Musa Kurya for yet another hearing.
